RECORDING CALLS

One-party consent

Michigan’s eavesdropping statute bans recording “the private discourse of others” without the permission of everyone in it. The Michigan Court of Appeals has read “of others” to mean that a participant may record a conversation they are part of (Sullivan v. Gray, 1982; Lewis v. LeGrow, 2003). Awava still tells callers when calls are recorded, because the statute’s wording is strict and your callers may be in all-party states.

SALES CALLS AND TEXTS

Michigan’s recorded-message sales call ban

Michigan’s Home Solicitation Sales Act bars telephone sales calls that consist “in whole or in part” of a recorded message. It defines a solicitation as a voice call and leaves out calls the person invited in advance and calls to existing customers. It does not mention texts, so texts to Michigan numbers follow the federal rules.

AI voices and the federal rules

On 8 February 2024 the FCC ruled that AI-generated voices count as “artificial” under the Telephone Consumer Protection Act, so calls a business places with an AI voice need the called person’s prior express consent. That ruling is about calls you place. An AI receptionist answers calls people place to you, and Awava does not use it to dial lists.
