One-party consent

Ohio’s wiretap law allows a person to record a call “if the person is a party to the communication or if one of the parties to the communication has given the person prior consent,” as long as the recording is not made to commit a crime or a harmful act. Awava still tells callers when calls are recorded, because your callers may be in all-party states.

Ohio’s telephone solicitor law

Ohio requires telephone solicitors to register with the Attorney General before selling by phone, to give their name, company and the sales purpose of the call within the first 60 seconds, and never to block caller ID. The law has exemptions, including for some retail businesses and for calls to past customers. It does not set calling hours or mention texts, so texts to Ohio numbers follow the federal rules.

AI voices and the federal rules

On 8 February 2024 the FCC ruled that AI-generated voices count as “artificial” under the Telephone Consumer Protection Act, so calls a business places with an AI voice need the called person’s prior express consent. That ruling is about calls you place. An AI receptionist answers calls people place to you, and Awava does not use it to dial lists.
