MONTANA

AI Receptionist for Montana Businesses

Yes, a Montana business can use an AI receptionist. Montana bans recording a conversation without the knowledge of everyone on it, but the statute itself says a warning counts: if one person gives the warning, either party may record. Awava’s greeting gives that warning, and it comes with missed-call text back and review requests. The AI Receptionist is included in AI Pro ($1,997 setup plus $397 a month), or $97 a month added to the Website or Core plan.

Or call (978) 630-7976 right now: an AI answers. That’s the demo.

THE RULES

What Montana law means for an AI front desk.

The three rules that shape how an AI receptionist is set up in Montana, each with the statute it comes from.

RECORDING CALLS

All-party consent or warning

MCA 45-8-213 bars recording a conversation with a hidden device without the knowledge of all parties. It excepts people “given warning of the transcription or recording” and adds: “If one person provides the warning, either party may record.” A recording notice in the greeting is exactly that warning.

SALES CALLS AND TEXTS

Montana solicitation and recorded-call rules

Montana allows telephone sales calls only between 8 a.m. and 9 p.m. at the called person’s location. It bans auto-dialed sales calls that play a recorded message unless a live operator gets permission first, with exceptions for existing customers and people who asked to be called. Montana defines a solicitation as a voice call, so texts follow the federal rules.

FEDERAL

AI voices and the federal rules

On 8 February 2024 the FCC ruled that AI-generated voices count as “artificial” under the Telephone Consumer Protection Act, so calls a business places with an AI voice need the called person’s prior express consent. That ruling is about calls you place. An AI receptionist answers calls people place to you, and Awava does not use it to dial lists.

HOW AWAVA SETS IT UP

Built around the rules from the first call.

Awava installs the AI receptionist, connects it to your number and manages it for you. These are the defaults for Montana businesses. How the AI Receptionist works

  • When calls are recorded, the greeting gives the warning first, the way MCA 45-8-213 describes.
  • The AI receptionist answers calls people place to you. It does not auto-dial anyone.
  • Missed-call text back answers someone who just called you, and replying STOP ends the texts.
  • Campaign texts go only to customers who agreed to hear from you, never before 8 a.m. or after 9 p.m.
  • If a caller asks, the AI says it is an AI and offers to have you call back.
FAQ

Questions Montana businesses ask us.

Yes. Montana law does not ban AI call answering. The rule that matters is MCA 45-8-213, which bans recording a conversation without everyone’s knowledge unless a warning is given. Awava gives that warning in the greeting.
Montana requires the knowledge of all parties, but the statute says a warning counts: “If one person provides the warning, either party may record.” Announcing the recording at the start of the call meets that.
Montana allows telephone sales calls only between 8 a.m. and 9 p.m. at the called person’s location (MCA 30-14-1412). Awava keeps campaign texts inside those hours too, and missed-call text back only answers someone who just called you.
